Terms of Service

These terms govern use of this website and engagement of Understory Landscape Company, LLC (“Understory”) for landscaping services in North Carolina. By using the site or engaging our services, you agree to them.

Consultations & estimates

The on-site design consultation is a paid service ($150) and its fee is credited toward any project we are engaged to build for the same property within twelve months. Project pricing is provided as a written, line-item proposal; prices are fixed for the scope described and remain valid for 60 days. Changes to scope are priced and approved in writing before the related work proceeds.

Scheduling & site conditions

Landscaping is weather-dependent work; scheduled dates may shift for rain, frost, or ground conditions, and we communicate changes as soon as we know them. Buried utilities are located through NC 811 before excavation. Conditions that could not reasonably be discovered before work begins (e.g., buried debris, undisclosed septic components, rock requiring mechanical removal) are addressed by written change order.

Warranties

Hardscape and drainage installations carry a five-year workmanship warranty covering settlement, structural movement, and drainage failure under normal conditions. Plants carry a one-year replacement warranty when the provided care instructions are followed; meadow seedings carry a two-season establishment guarantee. Warranties exclude damage from third parties, vehicles, animals, neglect, and extraordinary weather events, and are void where another contractor alters the work.

Payment

Projects are invoiced by milestone: a deposit to reserve a build slot (typically one third), progress payments as stated in the proposal, and a final payment on completion walkthrough. Maintenance plans are billed monthly and may be canceled with 30 days' notice. Late payments accrue interest at the lesser of 1.5% per month or the maximum permitted by law.

Licensing & liability

Understory is a North Carolina licensed landscape contractor (#2417) and carries general liability and workers' compensation insurance; certificates are available on request. Our aggregate liability for any claim is limited to the amount paid for the work giving rise to the claim, except where the law provides otherwise.
